Acceptance of Terms
By accessing or using this website, placing an order, or purchasing any products from JBA Offroad, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
If you do not agree, do not use this website or purchase our products.
These Terms constitute a legally binding agreement between you and JBA Offroad (“JBA,” “we,” “us,” or “our”).
1. Product Intended Use and Prohibited Modifications
JBA upper control arms and other suspension components are engineered and intended only for use as designed with the specific vehicle applications, lift kits, and geometry versions (Stock or High Caster) listed on the product page and in the official JBA Installation Manual.
You are expressly prohibited from:

Adding ball joint spacers of any kind to JBA upper control arms.

Modifying, altering, or changing the ball joint mounting area, ball joint retaining hardware, or any structural portion of the control arm.

Using JBA products on vehicles or with lift kits for which they were not designed.

Stacking multiple lift kits.

Any other modification that changes the intended geometry, leverage, or load on the product.
Any such modification or use constitutes misuse. Misuse voids all warranties (express and implied, to the extent permitted by law) and releases JBA from any and all liability for resulting damage, injury, or loss.
JBA strongly recommends professional installation by a qualified technician or experienced installer familiar with lifted suspension systems.
Improper installation or modification significantly increases the risk of product failure.
2. Warranties and Disclaimers
JBA provides the limited warranty described on our website and in the product documentation.
This warranty is the only warranty provided. EXCEPT AS EXPRESSLY SET FORTH IN OUR WRITTEN WARRANTY, ALL PRODUCTS ARE SOLD “AS IS” AND “AS AVAILABLE”.
JBA makes no other warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Modified Products: Any product that has been modified (including by the addition of ball joint spacers or any alteration to the ball joint mounting or arm structure) is sold strictly “AS IS” with no warranty of any kind, express or implied.
You assume all risk of using modified products.
3. Assumption of Risk
You acknowledge and agree that:

Suspension components are safety-critical parts.

Adding ball joint spacers or making other modifications increases leverage and stress on the control arm and can cause bending, cracking, or catastrophic failure.

Such failure can result in loss of vehicle control, serious injury, or death.

By purchasing and/or modifying JBA products, you voluntarily assume all risks associated with such use or modification.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JBA’s total liability arising out of or related to any product, order, or these Terms shall not exceed the purchase price of the specific product(s) giving rise to the claim (or, at JBA’s option, repair or replacement of the product).
IN NO EVENT shall JBA be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, personal injury, property damage, or any other damages, whether based in contract, tort (including negligence), strict liability, or otherwise, even if JBA has been advised of the possibility of such damages.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
5. Indemnification and Hold Harmless
You agree to indemnify, defend, and hold harmless JBA Offroad, its officers, directors, employees, agents, affiliates, and suppliers from and against any and all claims, suits, actions, demands, damages, losses, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to:

Your use or misuse of any JBA product;

Any modification of a JBA product (including but not limited to the addition of ball joint spacers or changes to the ball joint mounting or arm structure);

Your failure to follow warnings, instructions, or these Terms;

Any injury, damage, or loss resulting from the above.
This indemnification obligation survives termination of these Terms and your relationship with JBA.
6. Dispute Resolution – Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY.
It affects your legal rights.
You and JBA agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, or any product purchased from JBA shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

The arbitration will take place in Pennsylvania.

The arbitration shall be conducted by a single arbitrator.

Each party shall bear its own costs, unless the arbitrator determines otherwise.

Class Action Waiver: You and JBA agree that any arbitration or proceeding shall be limited to the individual claim between you and JBA. You waive any right to participate in a class action, class arbitration, or any other representative proceeding.

Judgment on the award may be entered in any court having jurisdiction.
Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm.
7. Governing Law and Venue
These Terms and any dispute shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles.
Subject to the arbitration provision above, any legal action shall be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of such courts.
8. Additional Terms of Sale
Ordering & Acceptance
All orders are subject to acceptance by JBA Offroad.
We reserve the right to refuse or cancel any order for any reason.
Pricing & Payment
Prices are subject to change.
Payment must be received before processing.
Shipping
We ship within the United States.
Shipping costs are the customer’s responsibility.
Returns
JBA offers a 365-day return policy on unmodified products.
Modified products are not eligible for return.

Professional Installation Recommended
JBA strongly recommends that all products be installed by a qualified professional technician.
Improper installation or modification may void warranties and increase the risk of failure.
9. General Provisions

These Terms constitute the entire agreement between you and JBA regarding the subject matter herein.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

JBA’s failure to enforce any right or provision shall not constitute a waiver.

You may not assign these Terms without JBA’s prior written consent.
By placing an order or purchasing products from JBA Offroad, you confirm that you have read, understand, and agree to all of the above Terms and Conditions, including the limitations on modifications, assumption of risk, limitation of liability, indemnification, and arbitration provisions.
